His problem is that he’s already on camera saying that he creeped up on him, engaged him and as he was turning jabbed him in the face and that johnson immediately turned swinging - he also stated clearly that his statement about constituents was simultaneous to him shoving him in the face.

With the way he’s putting himself on tape pretty much admitting to the crime, I think his most favorable outcome is a plea deal and a prayer that no one wants to make an example out of him.

It shouldn’t be a felony - I think the only reason it is in this case is that Johnson is a public figure and that is the way the law in CA seems to be.

This wasn’t a mayor attacking a protester. This was a guy fending off another guy who was attacking him. Him being mayor is only relevant in that his attacker now gets an extra special charge against him for assault.

Yeah, all of this has been updated. Others were seated, KJ was working through the crowd. A guy ran up behind him, grabbed him and shoved the pie in his face with force. Johnson immediately beat him back. It was all one action.

I don’t know enough aside from what I read, but I read that there assault on a public official charge is always a felony in CA. Not sure what class or if there are distinctions, but a felony is the low bar for the charge
