The underpinnings are not the same as as Pajero/Montero. Delicas are unibody. Pajero/Montero are body-on-frame. They share a IFS/solid rear and some similar brake parts, but they are not the same chassis.

The USDM-spec version has the FMVSS sticker and Maine wouldn’t care at all. This seems to be the sticky point.
