Not necessarily: Chuck's flinching reaction to the battery in his pocket could easily be explained away as a moment of shock at the deception. Jimmy's trick only works if there's no one in the courtroom who both understands electricity and is also willing to speak up on Chuck's behalf (including Chuck himself).
