But I don’t think that’s what was said, right? A decision was made against him, and, while the lawsuit seems to be based on unfair treatment, it is also premised on the illegitimacy of the decision.

I wonder if we can make the argument that being a woman in the present is being a woman in the present, trans or cis respectively, but being a woman in the present does not guarantee you were a woman in the past, hence the distinction between trans and cis.
