I’d argue Nintendo cares a little too much about the experience they cultivate, to the point where they try to punish anyone who doesn’t enjoy their products in the very specific way Nintendo demands.

Gamers have a portion of the fault.  It’s not like we haven’t been demanding ever increasing performance, ever more sophisticated hardware, etc.

That I’d argue is the more significant issue; providing a “service” at the price point the average user is willing to pay (nothing) while also actually making any money at all is kinda tricky.

Ya know, it’s one thing to say, “Pirating from Nintendo is always morally correct.” If that’s the angle you want to take, go for it. Even if it isn’t morally correct, and even if every pirated copy is a lost sale (spoiler alert: it’s not), Nintendo’s a big company and they will somehow survive even if five million

I wager he figured he’d get a cease-and-desist, eventually lose monetization that he almost assuredly had enabled for his Youtube video, and possibly get “black-listed,” which means less than fuck all when your local Target isn’t going to be asking for ID when you buy Magic cards.

Sony would assuredly use every legal power in their department to shut down your video detailing the game as well as determine how the leak happened.

They probably wouldn’t hire mercenaries to seize the game disc in question.

Hypothetically, Nintendo could start demanding take downs by virtue of some trademark holdings, but they would have to prove some sort of brand confusion or monetary damages.

Or a white cis het woman with massive hooters and a barely there skintight outfit.

Hypothetically, original characters and concepts CAN be subject to infringement, even in fan work (it’s why a lot of authors choose to be willfully blind about fan works and refuse to engage with their community).

It’s less “defend their actions” and more “don’t cry that you’re a victim when the tiger you were riding eventually mauls you.”

I’d say it’s more that Nintendo feels they have the right to dictate how you enjoy their product.  Which doesn't sound so bad until you actually think about it.

Yes... heaven forbid bad video game movies be made.

I really wish more people would realize this before they try and make this Bowser fellow some sort of modern day Robin Hood. It’s absolutely more than possible to have a profound distaste for both parties in this debacle.

Hypothetically... yes.

That’s kinda the thrust of it, huh?

They should. Let Nintendo do their own marketing like Nintendo so very clearly wants to do.

But they won’t. Because Nintendo IP brings eyeballs that they wouldn’t get if they were doing their own work or even modding someone else’s IP.
