It is absolutely possible that they were negotiating. In my experience, I’ve never done that (negotiated the morning of the deposition). But I can see that happening in this situation. But if that was the case, then I wonder why his lawyers are saying otherwise.

Yes, of course. Technically a deposition is a court proceeding but ultimately in an actual court Judges have a lot of discretion.
