That’s not what happened in this case. He didn’t make a claim based on parental rights or paternity leave. The claim that was dismissed is that he was discriminated against because of pregnancy, but the judge ruled that specific protection didn’t apply to him because HE was not pregnant.

If I understand correctly, the judged ruled that he couldn’t claim that his rights under Title VII were violated, because Title VII is written to protect people *who are pregnant* and not parents in general. Since he didn’t actually carry the child, Title VII doesn’t apply. Read more
