I’ve made the argument that impairment and BAC aren’t the same for years in different forms but people just ‘feel’ and get upset. It is possible for a person, especially at the low modern BAC limits are still well within the performance bell curve distribution of sober socially accepted driving.

That may be true where you live, but it’s not true everywhere. There are a lot of places that run DUI checkpoints or randomly pull people over near areas with lots of restaurants and bars in order to run sobriety tests.

Are they trying to measure impairment, or trying to measure BAC? They are not exactly the same thing. Habitual drinkers do seem to handle higher BAC with less impairment. BAC is easily and reliably measurable, but impairment is not quite the same.
