Note that in the Tesla response the said it is likely that other safety systems would have saved the driver and they were not activated because the car went under the trailer rather than hitting the tractor. So your example of a bus or other vehicle does not apply.

Chances are, if it had been a bus, the Autopilot system would have seen it and initiated an emergency braking action. They probably still would have collided, but at least then the front crumple zone of the car would have impacted the side of the bus.

The same way you opt in to drive with other people on the road. There is already a risk you take just by driving.

It says neither the driver nor the car could detect the trailer. The truck driver was at fault.

I can remember my Mother complaining about cruise control when I was younger because she was afraid people wouldn’t pay attention. Tesla isn’t selling an autonymous control system, it’s basically a really really advanced cruise control. That’s why there is a disclaimer.
