Really, the system shouldn’t have scratched disks even when being moved anyway. Plenty of laptop, portable, and car disk drives through the years somehow managed to not scratch disks while moving.

It is only going to basically define in a clearer manner what qualifies as a class action lawsuit and whether this case falls into that definition. If they side with the plaintiffs, all that means is that the case will go forward…
