There is a restraint for a reason. The parents decided not to use it. It’s no different than putting your kid in a car seat and not buckling them in. You take the chances you feel comfortable with. 

They’re insanely good at getting a baby to sleep. My daughter practically lived in one 24/7 for the first few months of her life because she would not fall asleep at all on a flat surface with nothing on it no matter what we tried. It’s only dangerous if you keep using it past the age where they can fall out.
