I don’t disagree about the PSI data being flawed, but Brady was still a part of destroying evidence in a potential lawsuit.

Oh, my god. Are you being willfully ignorant or just a normal Patriots fan? He ordered the phone to be destroyed/gotten rid of whether he did it himself or not. He allowed it to happen. He was party to evidence being destroyed.
Uh yeah, because he DESTROYED the potential evidence. Do you not understand that? Brady boned himself by destroying the phone. His lawyers should have known about the rules regarding evidence and pending litigation.
It’s not evidence because Brady DESTROYED the phone. So no one will ever know what’s on it besides Brady. In fact because of that if there was a jury trial the judge could instruct the jury to just assume that the phone was destroyed because there was incriminating evidence on it.
Brady would be required to keep evidence if he had reason to believe there would be an upcoming lawsuit. Which everyone knew there would be if Goodell upheld the suspension.
Uh. He definitely does. That’s like saying people who worked at Enron wouldn’t be able to sue them for anything they did wrong and have access to the damning documents.
I’m not siding with the NFL. I’m siding with the legal system. If you can destroy critical evidence without consequence then the system means nothing.

The destruction of the phone is much more a technicality in favor of Goodell
Except once he sued the NFL for upholding the suspension the NFL would likely have a legal right to examine the phone in discovery as they couldn’t get the texts from the phone company. What Brady did was essentially destruction of evidence.
And if Brady had accepted the punishment there’d be no problem with him destroying the phone. It’s when he sues his employer that the destroyed phone becomes a problem.
What Mr. Wells wants during his investigation and what the NFL’s lawyers may want in the following lawsuit could be different. This is especially pertinent once we find out that Brady, in fact, did not destroy all his phones when he gets a new one as evidenced by his ability to produce not one but two phones he owned…
Brady says that he did not turn over his emails and texts on advice of his lawyers, but if his lawyers had advised him to do so he would have. He also states that there were no emails or texts that he was worried about turning over
The NFL’s investigation was a private investigator, yes. That’s why the NFL couldn’t compel Brady to give up the phone, BUT you can’t destroy something that could be evidence if you know there is likely to be a pending lawsuit. And by all rights Brady, his lawyers, and the NFLPA knew they would sue if Goodell did…
