You can't put someone on the stand and not allow cross examination; that's a violation of the 6th amendment.

I think the issue between the two is one of standards of proof. We require that a criminal case be proved beyond a reasonable doubt, which is a very high and difficult standard to meet. Whereas there’s basically no standard at all for firing or for who to support entertainment-wise

At trial, the defendant would show their email exchanges to argue that everything was consensual. To combat that, you’d need to bring the victim to the stand to testify. She’d then get torn apart on cross-examination by the defense attorney. It would be extremely traumatic for her. Without her testimony to combat…
Yes, and? Just because it’s not a “civilized” defense doesn’t mean the defense attorney won’t present it. And there’s certainly enough there for one juror to decide that there’s reasonable doubt.
