Government procurement is heavily regulated. I am not sure about Puerto Rico law specifically, but generally speaking, if a provision of a contract conflicts with the law, it may not be enforced by a court. So PREPA may be able to defeat the contract’s abusive terms, if it decides to try.
You should probably update to include that FEMA is now saying that they never gave the go-ahead for the contract, despite the contract specifically saying as much. That’s not too shady though.
