I always wondered... isn't using these characters for monetary profit against copyright laws even though it is their own work/a piece of art? They are still Nintendo's property right?

the name is precisely the problem. Nintendo should have called the WiiU the Wii 2 or something completely different from the Wii branding. the PS Vita is suffering from the same problem.
