I hate it when people today try to analyze/impose their values on institutions of the past. If you’ve ever read Oliver Wendell Holmes’s “The Common Law” you’ll see that before there was Law there was Revenge, and in fact, the original suit at law was “Revenge” (or something pretty similar).
