No states can't just tax whatever they want. I agree it's not a first amendment issue but taxes must be applied equally to all citizens. One group cannot be singled out and taxed without a corresponding stated goal or reason given. If the stated goal or reason can also be applied to a group that ISN'T being taxed then

Eh. I mean I get your point but to me taxing a strip club and not say, the sale of playboy magazine or some such is like saying, "we're taxing cigarettes but not booze." I mean if their arguments are in earnest then there's a lot more that should (fairly) be included in this tax.

This is the problem with the way we view healthy eating in this country. Everything is so black and white, two extremes. It's possible to be a healthy person who occasionally indulges in some greasy goodness. The two things can exist on the same space time continuum.
