Well, that’s nonsensical. By your reasoning, it was outdated when it was passed. This was obviously about the areas which had done that. Not that they were still doing it (because it was illegal), but because those areas were known “problem” areas, and still are.
Also worth noting, the courts discussion said their reasoning was things had changed. They hadn’t. The courts are not there to change laws to your preference. If you want a more frequent update of the criteria, I could say you should have congress do it just as much as what you said.
