I think the idea of the new SA, Castro, effing him over because of politics is much more interesting. The writers established they have a deep connection—FP was his best man, for Christ's sake—and yet he's about to sell him down the river, just so he can get reelected. Becky Ann Baker was Toby's lawyer during the final season of The West Wing. She came in while he was being questioned in the Roosevelt room, I think, and she made an instant impression.

I think this is a case of the show's audience being older working for it. Had it been a big thing like TWD, perhaps it would have leaked, which would have made it less shocking.
