I think local law enforcement should use their best judgement before enforcing the law, and then courts can analyze that judgement and rule accordingly to make sure the law enforcement personnel's power stays in check.

Do you mean vaporized within 10min of dropping the bomb? Because, it was dropped from a plane in 1961 - and the pilot did get away. With 2014 technology, there are a number of aircraft that can handle the 27 ton bomb (disguised as an airliner).

What's the largest you expect, and how far away are you. If the Tsar Bomba were to hit (50megaton) I wouldn't want to be anywhere from Philly to New Haven, CT within 6 hours of detonation depending what direction the wind was blowing, and assuming only a gentle breeze.

While the flag is probably white, I am sure the pods are still there. The craters on the moon have been accumulating for Billions of years, and don't erode like those on earth. I don't think the pods are at any more risk of meteorite impact than our space station.

Concrete heats up as it cools... and if it is a very large pour you need to do something to take the heat away or it won't harden... you need to cool it. For example the Hoover dam installed cooling plants and ran cooling pipes through the concrete. It seems like you need to cool concrete, not heat it up..
