Well, the guy that supposedly gave the info in the affidavit didn’t sign it, said it did not represent what he said, and that he was three sheets to the wind when he talked to Tharpe’s lawyers. As I read the opinion, and I’m not a lawyer so I’m likely wrong, none of the lower court judges or courts gave the affidavit

Given that every judge/court that ruled on this matter sided with him, until it got to SCOTUS, I think the issue is more complex than whether Thomas has a soul.

Neither. Tharpe tried to get a Certificate of Appeal (COA). In other words, I guess he has to be allowed to appeal his sentence, he can’t just do it automatically. So this article is a little misleading because this guy did NOT get a “new appeal.” He just gets to go back and try to get one.

Right, maybe you’ll get lucky and get a bench trial with someone like Roy Moore deciding your fate.

No, the “procedural” problems the dissenters were talking about are summarized by Thomas as:
