As I read the opinion, and I’m not a lawyer so I’m likely wrong, none of the lower court judges or courts gave the affidavit…

Given that every judge/court that ruled on this matter sided with him, until it got to SCOTUS, I think the issue is more complex than whether Thomas has a soul.

Neither. Tharpe tried to get a Certificate of Appeal (COA). In other words, I guess he has to be allowed to appeal his sentence, he can’t just do it automatically. So this article is a little misleading because this guy did NOT get a “new appeal.” He just gets to go back and try to get one.
