Stories like this make me wish the people creating fan made games would just focus on original projects instead. I'm not an mlp fan, but the gameplay footage itself looked decent. If they had just made something original, they'd be able to continue their work.
Also, taking cartoon characters and making pornographic art out of them can possibly be defended as parody, commentary, or transformative work. No one who sees that will think it's legitimately sanctioned by the copyright holder.
One part of it is the potential harm to the franchise, and another would probably be trademark protection. TM law is kind weird. If they don't defend it, they lose it, more or less.
