I don’t really see what the upside is to threatening a lawsuit that everyone (and more importantly, their lawyer) knows you’re never going to file. When Manning eventually fails to follow through, it’s just going to make him look like an idiot at best and like he has something to hide at worst.

In order to sue for defamation, you have to prove that there is material damage (lost contracts, etc). There is no reason for a defamation suit until you’ve lost something, and right now Manning’s approach has to be to make sure nothing is lost to begin with.
