Depends on how you want to spin it.  I’d argue Nintendo put themselves there.  They shouldn’t have signed such a disadvantageous contract in the first place.

Imagine what Nintendo could have done with OoT and Mario 64 if the N64 ran on discs. The machine was more powerful, sure, but imagine the improvements to audio and texture quality that could have been achieved over what we actually got on cartridges.
