How would limiting scalpers drive up sales for Tesla? It’s not like there’s a huge market of Cybertruck people who are unwilling to wait but willing to pay $XX,XXX more that will now flee to other brands.

I’m not sure about the legality of enforcing the $50k fine clause, but they can almost definitely refuse you service in the future. Most laws give wide latitude to companies to choose with whom they do business with, usually as long as it’s not a reason that’s protected, like based on the colour of your skin.
