Multiple cams and eyewitness accounts all say the same thing: Stewart gunned the gas to pitch the back end out to hit him.

He intentionally pitched his car towards the kid, striking and killing him. He murdered that kid. That will be the charge, which will likely be negotiated down to vehicular homicide. As much as an injustice as it will be, Stewart and his millions will buy his way out of jail.
