Not sure I agree. Prison rape is pretty widely considered fair game. Nobody (or far fewer people than seem to be upset about this, in any case) gets in an uproar when someone makes a joke about dropping the soap, or even about castration.

Everybody has the right to be an asshole within the bounds of the law, and since no laws were broken and no rights were infringed on either side, it's not a legal issue. Like most disputes in life, this comes down to who you think the bigger asshole is.
