If we're looking at this as a five-act tragedy, wouldn't the climax be the end of Season 3, when Walt and Jesse's actions lead to them having to kill Gale, with seasons 4 and 5 being the falling action, with Jesse pushed into an emotional state and metaphorical and literal imprisonment, Hank being led closer to Walt,

Maybe Marie informed the DEA of how he was working with Hank to help bring down Walt, told them about the confession which is maybe still at the AB compound.
