Are we absolutely certain that Toby's not the Strangler? Seems plausible that Toby visited the convicted guy in prison and taunted him that not only was the Strangler still on the loose, but that he'd helped put the wrong guy behind bars.  The guy in prison snaps, tries to choke Toby, and voila.
