That's the justice system and reasonable doubt - I agree he probably did it, which is why the civil suit was satisfying - but the standard for removing liberty is beyond a reasonable doubt - and there was plenty in this case.
As I understand it, you cannot selectively use the 5th amendment, if he answered that, then he would have had to answer all the questions
The jury was not present or told of Furhman's taking the 5th, they were told that he was unavailable to appear
If you want to really be saddened - watch the social media reaction the recent Jian Ghomeshi case - where people are angry that a woman would defend a man, that accused should have to prove their innocence, or that no witness should ever have their credibility impeached.
