I missed your questioning of Jay-Z's legend status, but I'm kinda with you on that. Although I'll accept that he's legitimately a legend now, I think he got "promoted" to legend status prematurely and wonder if he'd have gotten there without that perception gaining traction to begin with.
It's really only a difference of degrees (although the degree of difference between trademark and copyright can be pretty sizable); it was a still a dick move on Jenner's part to try and TM a single name.
It's not criminal, and generally copyright infringement cases don't end up in court unless the infringers continue even after they've been notified. Since they've pulled the shirts and apologized, it's probably not going any farther.
