if the jury is deadlocked the Prosecutor can try him again with a new jury. then if he's acquitted the appeals will begin, but the Judge might not let him out of jail pending appeal.
for criminal it's always 12 (in MD civil juries are 6 people), and a long deliberation, in my experience, is always verve wracking, especially if they ask a lot of questions. It is almost always a not guilty when they come out quickly.
