while I generally agree with you this case is super petty and the judge is going to laugh it out of the courtroom. he has no cause of action.

well the time of day of the calls can be relevant if the purpose is to frighten or annoy the victim, but if she's usually up that late, then no. the real key to harassment by phone id being told by the victim to stop and then continuing to do it.

harassment is a continuing course of conduct with the intention to annoy the victim. Here he called her twice and her sister once you get his money, if she told him to stop calling and he continued, then its harassment. if she ignored the calls and he stopped after 3, then it's not. at least in MD.
