ok, so this makes me a detail obsessed fan, but I think the mother's name is Tracy. In season 1, Ted meets a stripper named Amber, who leans in and says 'actualy, it's Tracy', and then Ted's kids scream "what!?".  He is kidding, but I think that suggests what her name will eventually be.

I don't think that waiving a civil suit was a part of the deal, it was that by acknowledging the prosecution had enough evidence to convict (even without the dna) the girls wouldn't be able to win a lawsuit.
