The major issue here is trust: why would the plaintiff trust the defendant? It's not likely to happen, so they'll probably want a contract, which they'll probably want to get a lawyer to peruse just to make sure it's fair and enforceable. Any agreement made between the plaintiff and the defendant is still subject to a judge's approval, in this case, since Neil Gross is actually offering a legitimate job, probably with a complicated contract allowing them to keep this position for years or get an optimal severance package should it not work out
