I think you're approaching this in a weird way. I don't remember seeing anything that suggested the girls wouldn't have had to pay a contigency fee, but the fee is based on the clients' net recovery (IE, the damages the defendant has to pay). You can come to a settlement that does not require the defendant to pay

The Kalinda storyline was only good for more Lana. Everything else was pretty decent. Certainly not batting 1000, but I found the conclusion to the "Did Peter cheat?!" storyline pretty funny. The trustee continues to be ballin', and though the idea behind the case felt kind of familiar, it was pretty interesting

Yeah, this episode definitely lost a lot of last season finale's momentum. Backstepping the Klaus-Tyler setup was particular disappointing since they seemed to be setting up the switcheroo to last longer. But at least Joseph Morgan's a regular this season and he has no other purpose than getting in Caroline's pants—
