I agree that it was wrong of FOX to do it, just like it was wrong when they ripped off DJ Earworm and Greg Laswell, but Coulton is a Whiffenpoof. It's kind of hard to buy him as a beleaguered underdog when he's pulling in over 500k a year and has his own annual celebrity cruise.
He had to pay, but IIRC it's a low-fixed rate. He didn't need permission, though. Here's how I understand his current situation:

But the whole point of the show is that the rich are sort of stupid (Hence Lord Grantham losing the estate's future because he's a fuckwit) and that their lifestyle can't withstand history (hence the family losing children and getting increasingly disgraced as the years wear on)

I think that at this point Malcolm is desperately trying to get back into government because he's realized that he's just not an opposition guy. Hes out of his comfort zone and into a space where his tricks don't work because he has less power backing him up.

I think that it's probably more to do with the fucker not being recurring character material or not wanting to stick him alongside Malcolm. Since Coulson is up to his fucking ears in Hackgate and the back end of this season is supposed to be a Leveson-style ethics inquiry, it seems almost too good not to use him.
