NBC gives the affiliates a certain number of hours each year that we can pre-empt and the timing of those pre-emptions is almost entirely at the affiliate's discretion.  The Salt Lake City affiliate used some of theirs in 2011 to keep The Playboy Club off the air, for example.

Nielsen DOES track DVR recordings, out to seven days after original airing.  The problem isn't with Nielsen or their methodology, it's with the advertisers who insist on using ratings from Live, meaning you watched it at the original air time, or maaaaaaybe Live + Same Day, meaning you DVR'd a program and watched it…
