The fact that the testing guy didn't speak perfect German is hardly a flaw - I'm sure Madrigral employees non-native speakers, like every virtually every other big corporation in the world, particularly in a post-Schengen-Agreement Europe.

Have we ever figured out who tipped off Hank before the showdown with the hitmen?  I've always suspected Merkert as the mole, but him bowing out now without fanfare seems to make it unlikely we'll ever get to see him outed if that's the case.

Well, that scene was there so that we could see the characters interact - I think it was pretty out-of-character for Gus, and instead of revealing his incompetence as a boss, it reveals more a weakness of the writers/showrunners for prefering a really cool scene over consistency of tone.
