It would definitely be illegal to lie to a Commission of Inquiry, even moreso a Royal Commission (not sure which this is, but I'd assume the former, Royal Commissions are quite rare). I actually thought when Malcolm was asked to stand up it would be so he could be formally charged.

It's not unethical, it's just embarassing for the government. Malcolm was reprimanded for discussing it precisely because he was just using the inquiry as a pulpit for irrelevant point-scoring.

Sureka seems to be based off of Baroness Warsi, although only loosely. Warsi was involved in some minor scandals but nothing of the scale that would get her peeled off an inquiry. (Also, Sureka was a mid-ranking cabinet member, and as such wouldn't get appointed to an inquiry).

In theory some of the inherited Peers sit in the House of Lords and could be appointed to inquiries. In practice they almost never do because their continued presence there is quite unpopular.

I did find that a bit odd, but I presumed that the public was still so disdainful of Nicola and enthused about Dan that he would actually gain, or at least not lose, public sympathy for admitting to having put the boot into her.
