Also, now that I've read the complaint, I've gotta say: Kaplan's lawyer loves the word "defalcate".  To read this complaint, you'd think Hutz spent all of his time defalcating all over the band.

The article is seriously misleading in that it states that the "members of the band" are suing Hutz.  I've just checked the complaint, and Kaplan is suing on his own behalf, as well as bringing a derivative action on behalf of Gypsy Punks LLC, which, IIRC, is the legal entity for the band as a whole.  So, in effect,…
