You misstate Bosch’s liability. All engine management code allows for testing modes, even the crappy Hella garbage that powers my motorcycle. While the Bosch code enabled cheating, it did not force cheating. If that were the case, millions of gasoline vehicles would be out of compliance, also, and there is credible
