That blanket statement about gun possession is wrong. There are many times when just possessing a gun is illegal. Is he a felon? Illegal. Has he ever committed a violent crime while in possession? Illegal. Was he concealing it without license? Illegal. Was he in the act of or had he recently committed a crime?

It depends entirely on how the statute is written. If there is a specific objective standard written in (sound my not exceed X dB), you are 100% correct.
