good point. but, if the 12 weeks being offered is exclusively for parental leave, then couldn’t it exceed FMLA? for example, say a mother has already used 8 weeks of FMLA before the birth of a child. child is born. extra 12 weeks. there is a type of plea argument that does not bind the court. it’s an 11(c)(1)(b). however, an 11(c)(1)(C) does in fact bind the court once the court accepts the agreement. so it really just depends on what kind of deal his defense negotiated.

im not sure how much of it has to do with money. it may seem absurd to someone who doesn’t work in criminal law, and i understand that, but i am a defense attorney and I’ve worked on plenty of cases with similar results, for defendants who have no money (or fame).

i’m confused about the charge in NYC with the 17 year old. 17 is age of consent in NYC. sleazy, but no crime (unless there was porn involved). obviously, they still have a solid case against him for the other charges.
