I'd imagine that the people pirating the game rather than purchasing it legitimately while having a jailbroken iphone would be using a cracked version already stripped of the DRM.

Jailbroken iPhones can install apps from things called Depositories. Much like turning off the signed apps settings on an android, you can then use this to install cracked apps. The cracked apps have already gotten rid of the DRM. Where as legit copies still have it, and can get penalised by it if there's a fault or…
