Your scenarios assume honest police and informed judges. Sadly, both of those are few and far between. 4th Amendment protections are regularly ignored and abused by FISA courts.

Like companies promise to delete and never share your metadata, they reliably turn out to lie. I still wouldn’t trust DNA databases to be honest even with a law to prohibit the practice. There’s just too much money to be made from selling your data.
