It depends on how the state laws are written. In some states, DWI isn’t limited to alcohol, he could have been Driving While Impaired of prescription medicine or the interaction of the medicine and alcohol.

While this may have been true, he should not have been arrested. I was pulled over and blew a . 018 and they have to let you go at that point. No matter what, you will fail the field sobriety test so the sooner you can blow on the breathalyzer the sooner you can be on your way, assuming you are under the limit
