true, but what you’re saying is that emotional reactions to trauma may not be logical or make sense to those who havent been traumatized. The response brief should bring this up and the science on the post-trauma behavior of victims should be brought into evidence to help litigate this.

yes you are mistaken. Your first sentence pertains to damages. The second pertains to a theory of liability. To win anything you have to prove that you were actually harmed. People do negligent shit all the time, but if no one gets hurt no one can sue.
