No. Jailbroken iPhone or rooted Android can still access their respective stores. Moreover, it's still easy on either platform — there are even applications that allow you to search a game, click it, and then play it. There are no more negative costs than doing something like this on the PC, or a Wii.

Pirating mobile games is completely doable. On most Android devices, it's pretty easy. I know because I did pirate the full mobile version of Minecraft to see if it would be worth the quid for it. It was not, and did not hold my interest for long.

What parts are you going with for your build?

Several of these games appear to be Flash files, some have different versions for different OSs, and Wine is often a decent solution for indie games. I'll be grabbing this on my Debian machine.
