Actually it depends on which NYS agency you go with. I had a Port Authority transponder, and as soon as they imposed the maintenance fee I switched to the Thruway authority which doesn’t charge them. 

I have acutally taken my transponder and used it in the rental car, and kept their transponder in the little box. 

It isn’t outdated NAV data, it is most likely they are using an off the shelf personal GPS unit, not a commercial GPS that can be set to account for the height of the vehicle.
